If a Student NO LONGER HAS A DISABILITY, Must They Be Evaluated?

 

The public agency shall evaluate a student with a disability before determining that the student is no longer a student with a disability. [34 CFR §300.534]

 

However, an evaluation review is not required before termination of a student’s eligibility due to graduation with a regular high school diploma or attaining age of ineligibility. [34 CFR §300.534(c)(2)].
